vmware capacity license

Short question: when VM/server* (vmware) will be excluded from be counted inside license capacity report ?

 

situation A)

VM is NOT client in CV. It was just backuped by vmware subclient trough last year and now follow rules is excluded from next vmware backups. 

 

situation B)

VM was & is client in CV as  beside to above vmware backup it was also MS SQL (agent) backup done for  it . It it not  backuped by vmware anymore but is still part of MS SQL (agent) backup

To my knowledge VM licensing works as follows...

"If" you have a VM socket or VM count license and the VM is only being backed up via VSA agent it will count against the count license and not capacity.  

If you also have an agent installed, the VM backup will still count against the VM/socket count but the agent will count against capacity.

If you do not have any VM based license, then the VM backup regardless of agent installed or not will count against capacity so there could be situations where the VM is counting twice against capacity... Once for the VM backup, and if they also have a FS agent on that VM it will count again against capacity for the FS agent
